These Terms of Use (“Terms”) are an agreement between you and Proform E Solutions LLC (“we”, “us”) about your use of the VISNIRA™ app and this website. By creating an account or using VISNIRA, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use VISNIRA.
Apple’s terms
You downloaded VISNIRA from Apple’s App Store, so Apple’s standard Licensed Application End User License Agreement also applies to your use of the app. If these Terms and Apple’s standard terms conflict, Apple’s terms control for the license to use the app. Apple is not a party to these Terms and is not responsible for the app, its support, or any claims about it.
Who can use VISNIRA
- You must be at least 13 years old. We ask for your date of birth and do not create accounts for children under 13.
- If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.
- You must give accurate information and keep your sign-in details private. You are responsible for what happens on your account.
What VISNIRA is
VISNIRA is a personal planning tool: tasks, habits, goals, notes, reminders, focus sessions, reports and optional finance tracking that you enter yourself. It helps you organize your time and build routines. It does not guarantee any result.
Not professional advice
VISNIRA provides general information and planning tools only. Nothing in VISNIRA, including content from its AI assistant, ready-made plans, reports, nudges, or the finance and “freedom number” features, is financial, investment, tax, legal, medical, or mental-health advice, and nothing is a recommendation to buy or sell any asset. Assets can lose value and results are never guaranteed. Please speak with a licensed professional about your own situation. If you are in crisis or need urgent help, contact your local emergency services.
AI features
VISNIRA’s AI assistant can make mistakes and may misunderstand you. Please check anything it creates for you. AI features only run if you have given your permission on the in-app permission screen, and you can turn them off in Settings. We limit how much AI each person can use per day to keep the service sustainable. See the Privacy Policy for what is sent to our AI provider.
Your content
You own what you put into VISNIRA, such as your tasks, notes, photos and reflections. You give us permission to store and process it only as needed to run VISNIRA for you, as described in the Privacy Policy. You are responsible for your content and must have the right to use it.
Acceptable use
Please do not:
- break the law or use VISNIRA to harm, harass, or deceive anyone;
- try to break into, overload, copy, or reverse-engineer VISNIRA or its servers;
- use VISNIRA to send spam, or share content you do not have the right to share;
- use automated tools to access VISNIRA in ways we have not allowed.
Sharing
When you share a plan, an invite, or your weekly numbers, you choose who receives it. Please share responsibly and only things you are comfortable with others seeing.
Paid features
VISNIRA is free to use today. If we offer paid plans in the future, the price, billing period, and renewal terms will be shown clearly before you buy. Purchases will be handled by Apple, and refunds and cancellations follow Apple’s rules. We will update these Terms before any paid plan starts.
Availability and changes
We work to keep VISNIRA running, but it may sometimes be unavailable or change. We may add, change, or remove features, and we may update these Terms. If a change is important, we will tell you in the app or on this page, and the effective date above will change. Using VISNIRA after a change means you accept it.
Ending your use
You can stop using VISNIRA at any time and delete your account in Settings, which removes your data as described in the Privacy Policy. We may suspend or end access if someone breaks these Terms or puts others or the service at risk.
Disclaimers
VISNIRA is provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that it will be error-free, uninterrupted, or suited to your particular needs, and we disclaim all warranties not stated here.
Limit of liability
To the fullest extent the law allows, Proform E Solutions LLC will not be liable for indirect, incidental, special, or consequential damages, or for lost data, profits, or opportunities arising from your use of VISNIRA. Our total liability for any claim is limited to the greater of the amount you paid us in the past 12 months or US$50. Some places do not allow these limits, so they may not apply to you.
Governing law
These Terms are governed by the laws of the United States and of the state in which Proform E Solutions LLC is organized, without regard to conflict-of-law rules. Local consumer-protection laws that cannot be waived still apply to you.
